When Does a Building Compliance Certificate (OCC) Become Relevant for a Sale?

While an OCC is not required to resell a property, it can become a problem in two situations:

  1. Unapproved additions or alterations — if the current owner or a previous owner added a room, garage conversion, or outbuilding without approved building plans, those structures are technically unapproved. The buyer’s conveyancer or bank may require the seller to either obtain retrospective building plan approval and an OCC for the additions, or demolish them. This is a separate process from a CoC and is handled through the municipality.
  2. Bond conditions — some banks, as a condition of granting a mortgage bond to the buyer, require evidence that all structures on the property are covered by approved plans. This is not a legal requirement for transfer but is a bank’s internal policy.
Key distinction: An Electrical CoC confirms the wiring is safe. An OCC confirms the building is legally constructed. You need an Electrical CoC for every sale. You need an OCC for new buildings and approved additions — not for routine resales of existing homes.

Other Documents Sometimes Confused with a CoC

Beetle/Borer Certificate

Confirms the property is free from woodborer infestation. Not a CoC — not covered by the Electricity Act or OHS Act. Required by some banks as a bond condition. Issued by a pest control company registered with SAPCA.

Home Owners Warranty (NHBRC)

Issued by the National Home Builders Registration Council for new homes — a structural warranty. Not a CoC, not required for resales, valid for 5 years from original construction completion date.

Body Corporate Rules Certificate

For sectional title schemes — confirms the buyer has received a copy of the body corporate rules. Not a CoC. Required for sectional title transfers under the Sectional Titles Act.

Rates Clearance Certificate

Confirms all municipal rates and taxes are paid up to date. Required for all transfers but is not a compliance certificate — it is issued by the municipality’s revenue department, not an inspector.
